| Experience within the Civil Engineering Group with Outsourced Design Services |
| Abstract
In April 1996 CERN awarded three contracts for civil engineering design services associated with the LHC project. The three contracts were awarded to three different joint ventures of firms from five member states. The total bid price for these services was in excess of 35 MCHF and the contracts will run for a total of around seven years. This paper aims to discuss and analyse the experience gained to date in the management of these contracts. In particular, the paper will address the issues of conditions of contract and specification for this form of contract. Current experience with each of the three consultants will be presented with the areas of difficulty highlighted. Conclusions will be made regarding future use of such contracts and in particular the way in which CERN must change in order to work efficiently with external designers. |
| The Role of CERN in the Large Construction Contracts for LHC Civil Works |
| Abstract
The contracts for the LHC civil engineering construction are based upon the standard FIDIC document entitled "Conditions of Contract for Works of Civil Engineering Construction". FIDIC is a reputable supra-national and world-wide Federation of Consulting Engineers focused in the definition and regulation of the role of many parties involved with the International Construction Industry. An overview of FIDIC and other Organisations, such as the World Bank, standard documents is presented. The difference between standard Contract documents and standard Bidding documents is pointed out. In view of CERN’s status as an intergovernmental Organisation, the original FIDIC standard documents needed to be adapted. The modifications are identified and explained. A concise definition of the role of each party concerned by the LHC Construction Contracts, i.e. the Contractor, the Engineer and the Client (CERN), is made.Finally, a brief cost-benefit analysis on this particularly Contract drafting exercise is presented along with some preliminary conclusions and an outline of foreseen difficulties with the Contract management. |
| Procédure de Sélection pour les Contrats de Génie Civil |
| Abstract
Après un rappel de quelques caractéristiques du projet LHC Génie Civil, la procédure de sélection est décrite aux deux niveaux auxquels elle a été appliquée successivement : le choix des consultants, puis celui des entreprises. Par un découpage géographique approprié, le projet a été divisé en trois lots d’études et quatre lots de travaux, qui ont tous fait l’objet de cette procédure nouvelle au CERN. Les avantages et inconvénients nés de l’application de celle-ci sont succinctement décrits. Il est particulièrement insisté, à ce titre, sur la transparence, la compatibilité avec les règles d’achat du CERN, et l’obtention, en final, de choix plus fiables que précédemment. Enfin, quelques considérations sont données sur les possibilités d’élargissement à d’autres spécialités que le génie civil, ainsi que sur les tendances qui se dégagent pour le futur en matière de procédures d’appels d’offres de grands travaux. |
| Choix des Consultants Extérieurs pour les Projets Secondaires |
| Abstract
Les "petits projets" sont généralement inférieurs à 200KCHF et techniquement peuvent être très variés : installation de monorails dans des structures existantes, construction de fosses transformateurs, d'abris de stockage, de murs de soutènement, modification ou extension de bâtiments existants. Il reste à constater qu'à l'origine la définition par l'utilisateur est souvent incomplète. Par manque de personnel et pour la réalisation de certains "petits projets" le groupe génie civil doit faire appel à l'assistance d'architectes ou de bureaux d'ingénieurs spécialisés tel que : béton armé, charpente métallique, géotechnique. Le bureau d'ingénieurs mandaté doit pouvoir fournir, dans des délais généralement très courts, les prestations suivantes : mise au point et finalisation du projet en accord avec le CERN, établissement des plans d'exécution et des textes de soumission, surveillance des travaux, expertises diverses. Un mode de règlement des honoraires y relatif adapté aux conditions du marché et de la concurrence est à définir. |

| The revised purchasing procedures have improved the selection of our
contract partners and the scope of the work has become increasingly well
specified through performance or manufacturing specifications. Despite
these improvements, experience shows that many problems still occur during
the execution of contracts. The reasons are amongst others, tighter budgets
and planning, multinational consortia, high complexity of technical requirements.
Many of the problems could be minimised or avoided if they could be anticipated or when they occur, proper action is taken. This requires before the start of the work a proper definition of the scope of the contract, an involvement of the different services at CERN and an understanding of the technical, commercial and legal aspects by all parties. |
